Phase I. Labor Certification Process
Reduction in Recruitment (RIR)
1. Two copies of Application for Alien Employment Certification
(Form ETA 750, Parts A and B)
2. Forms G-28 Notice of Entry of Appearance in duplicate.
3. Supporting letter from Company/Employer concerning
recruitment efforts
4. Internal Job posting documentation
5. Documentation of major newspaper (Wall Street, Boston Globe,
Boston Herald) or Technical Magazine (Info
World, Computer World, Networld) advertisements;
Company website advertising;
Recruiter invoices and contract, on-line
recruiting efforts including
but not limited to copies of job postings
from Monster.com,
HotJobs.com, Techjobs.com…
6. Supporting documentation including applicant’s resume, degrees,
transcripts, H1-B (Form I-797A) approval,
letters of experience, and additional certifications.
• Copy
of passport (cover to cover) and 1-94 (if applicable).
• Resume
that describes:
• Education,
Work Experience, Special skills, Project details
• Copies
of all degree certificates, i.e., Bachelors, Masters, etc.
• Copies
of transcripts (marksheets) from all colleges for all degrees.
• Copies
of all diploma or training course certificates.
• Results
of any technical exams passed (if applicable).
• Documents
proving completion of high school, i.e., secondary and
higher secondary school
exam results, school leaving certificates
(if available), etc.
• Letters
of professional references, recommendations, etc.
• Awards
or other types of recognition (publications, etc., if applicable).
• Copies of "Notice
of Action" from Immigration and Naturalizatiol
Service for any previous
petitions filed on behalf of the alien, including prior
H=1, H-4, etc.
Non-RIR (Ordinary Guideline):
The difference is that you will comply with the DOL requirements
but running advertisements (while your Labor Application is in process)
in various publications to ensure proper recruiting efforts were conducted.
As opposed to RIR where the employer has already exhausted all efforts
to recruit someone with this type of background and can establish
the pattern of recruiting efforts via advertisements.
Phase II. Alien Immigrant Petition (I-140) With
The Immigration
& Naturalization Service (INS)
1. Check in the amount of $115.00
2. Form I-140, Immigrant Petition for Alien Worker
3. Form G-28, Notice of Entry of Appearance in duplicate
4. Letter from the employer in support of application
5. Final Determination from U. S. Department of Labor with
Certified
Forms ETA 750 (parts A and B)
6. Copies of Degrees (Bachelor’s & Master’s)
from Overseas and U. S.
7. Copies of W-2 (1999 or 2000) and a recent pay stub
8. Copy of an Evaluation of Foreign Education and Training
9. Copies of resume, transcripts, certification, &
employer
reference letters
10. Copy of passport, H1-B approval (Form I-797)
11. Marriage certificates (if spouse will apply)
12. Evidence of name change (including maiden name, etc., if applicable)
13. Copies of "Notice of Action" from Immigration and Naturalization
Service for any previous petitions
filed on behalf of the alien, including prior
H=1, H-4, etc.
Phase III. Adjustment of Status (I-485) with The
Immigration & Naturalization Service (INS):
1. INS filing fees currently $220
2. Form I-485 Adjustment of Status
3. Form I-485 Supplement A
4. Form G-325A Biographic Data Sheet
5. Form I-693 Medical Examination
6. Finger Prints -Submit add’l fee of $25 and INS
will notify you
when/where to get them
7. Form I-864 (Affidavit of support) not applicable for
employment based
8. Form I-765 (Authorization for Employment) - INS ff’s
of $100
9. Employment Letter on Company letterhead- Should include
language
that the job on which visa petition
is based is still available to you. It should
include salary as well.
10. Two (2) photographs, Form I-94, birth certificate, copy of passport,
marriage certificate, spouse birth
certificate, etc..
Consular Processing: Packet 3 (Vary from Country
to Country say China vs. France).
1. Form OF-230 Part I-Application for Immigrant Visa and
Alien
Registration (Biographic Data)
2. Employment Letter on Company letterhead- Should include
language that the job on which
visa petition is based is still available to you.
It should include salary as well
3. Passport, Birth Certificates, Police Certificates,
Court records,
Military records, photographs, marriage
certificate (certified), Translations
of foreign documents
4. Consulate will notify u about the Interview date, Medical
exam and ff’s $325.5. Form
I-864 (Affidavit of Support) not applicable in a standard
employment based app.
6. Obtain a copy of your Immunization (vaccination) records
from your health care Co.
